EB-5 Unreserved Category: Annual Limit Met

Important Notice: EB-5 Visa Availability for FY2024

The State Department and U.S. Citizenship and Immigration Services announce that all available Employment-Based Fifth Preference (EB-5) unreserved visas for fiscal year (FY) 2024 have been issued. This means no further EB-5 unreserved visas (C5, T5, I5, R5, RU, NU) can be issued until October 1, 2024, the start of FY 2025.

This action is in accordance with the Immigration and Nationality Act (INA), which limits the number of employment-based preference immigrant visas issued annually. The EB-5 Reform and Integrity Act of 2022 allowed for the use of unused FY 2022 reserved visas in the FY 2024 unreserved categories. With all these visas now allocated, processing of new applications in these categories will resume on October 1, 2024.
